Đăng ký kiểu dáng công nghiệp tại Thanh Hóa. Thanh Hóa là một trong các tỉnh lớn của nước ta, nền kinh tế tương đối phát triển. Hàng hóa, dịch vụ rất đa dạng.
Để hàng hóa, dịch vụ có thể tới tay được người tiêu dùng, được nhiều người tiêu dùng biết đến, các công ty cung cấp hàng hóa, dịch vụ phải tạo được ấn tượng, thu hút được khách hàng. Một trong những cách thu hút được khách hàng đó là hình dáng bên ngoài của sản phẩm. Hình dáng bên ngoài của sản phẩm thể hiện bằng hình khối, đường nét, màu sắc hoặc sự kết hợp của các yếu tố này được gọi là kiểu dáng công nghiệp.
Để tránh các hành vi xâm phạm của các chủ thể khác, pháp luật đã tạo hành lang pháp lí bảo vệ quyền của các công ty đối với kiểu dáng công nghiệp của hàng hóa, dịch vụ của mình. Tuy nhiên, để được bảo hộ, các công ty phải thực hiện đăng ký kiểu dáng công nghiệp tại Cục sở hữu trí tuệ.
Các chủ thể có quyền đăng ký kiểu dáng công nghiệp:
– Tác giả tạo ra kiểu dáng công nghiệp bằng công sức và chi phí của mình.
– Tổ chức, cá nhân đầu tư chi phí, phương tiện vật chất cho tác giả dưới hình thức giao việc, thuê việc trừ trường hợp các bên có thỏa thuận khác.
– Trong trường hợp có nhiều tổ chức, cá nhân cùng tạo ra hoặc đầu tư để tạo ra kiểu dáng công nghiệp thì các tổ chức, cá nhân đó có quyền đăng ký và quyền đăng ký đó được thực hiện nếu được tất cả tổ chức, cá nhân đó đồng ý.
– Đối với kiểu dáng công nghiệp được tạo ra do sử dụng cơ sở vật chất – kĩ thuật. kinh phí từ ngân sách nhà nước thì sẽ do các cơ quan nhà nước đăng ký theo quy định của Chính phủ.
Quyền của tác giả, chủ sở hữu đối với kiểu dáng công nghiệp được pháp luật bảo hộ khi kiểu dáng công nghiệp đó được đăng ký. Một kiểu dáng công nghiệp được đăng ký sẽ loại bỏ được các chủ thể xâm phạm.
Việc đăng ký kiểu dáng công nghiệp là tác giả và chủ sở hữu nộp đơn đăng ký tại Cục sở hữu trí tuệ. Trong thời gian 12 -14 tháng nếu không gặp phải sự phản đối của chủ thể nào và đáp ứng đầy đủ điều kiện để bảo hộ kiểu dáng công nghiệp thì sẽ được cấp Giấy chứng nhận đăng ký bảo hộ kiểu dáng công nghiệp.
