Đăng ký bảo hộ nhãn hiệu dươc phẩm tại Việt Nam. Việc đăng ký bảo hộ nhãn hiệu dược phẩm ngày càng đươc các doanh nghiệp chú ý hơn trong quá trình sản xuất và phát triển thương hiệu.

Để đăng ký bảo hộ nhãn hiệu dươc phẩm cần chú ý những gì, quy trình, thời gian thủ tục ra sao… Để đáp ứng các điều kiện về bảo hộ nhãn hiệu dược phẩm các doanh nghiệp cần chú ý những vấn đề sau:

Thời gian bảo hộ nhãn hiệu:

Theo như quy đinh của pháp luật thời gian đăng ký của nhãn hiệu cũng như thời gian đăng ký nhãn hiệu dược phẩm theo quy trình sau:

+    Thẩm định hình thức đơn nhãn hiệu trong vòng 1- 2 tháng. Trong thời gian này việc thẩm định đơn nhãn hiệu sẽ cho Quý khách hàng biết đơn nhãn hiệu có được chấp nhận các yêu cầu về măt hình thức hay không? Có phải sửa đổi đơn, bổ sung đơn.. từ đó Cục SHTT sẽ ra quyết định chấp nhận đơn hợp lệ vê mặt hình thức.

+    Thẩm định về mặt nội dung: 9 – 10 tháng. Việc thẩm định nội dung là giai đoan quan trọng nhất của nhãn hiệu mà từ đó các Doanh nghiệp biết được khả năng đăng ký chính xác nhất nhãn hiệu của mình có được cấp văn bằng bảo hộ hay không? Có đáp ứng về mặt nội dung và các quy định về điều kiện bảo hộ nhãn hiệu hay không. Trên cơ sở đó Cục SHTT ra quyết định cấp hay từ chối cấp văn bằng bảo hộ cho nhãn hiệu.

+   Ra thông báo cấp văn bằng bảo hộ và cấp văn bằng bảo hộ 1- 2 tháng. Trong thời gian này các đơn đáp ứng được yêu cầu về mặt bảo hộ thì sẽ được Cục SHTT công bố cấp văn bằng bảo hộ.

Thành phần hồ sơ cần thiết:

  • 02 Tờ khai đăng ký nhãn hiệu.
  • Mẫu nhãn hiệu đăng ký.
  • Nhóm sản phẩm, dịch vụ cần đăng ký.
  • Mẫu giấy ủy quyền ( trong trường  hợp thông qua đại diện).

Phạm vi dịch vụ của NACI Law:

  • Tư vấn cho Quý khách hàng những thủ tuc, thơi gian trước khi tiến hành đăng ký.
  • Tra cứu sơ bộ (miễn phí) giúp Quý khách hàng có thể biết được khả năng đăng ký của nhãn hiệu nhằm giảm khả năng đăng ký, tốn kém thời gian và chi phí.
  • Tiến hành soạn thảo hô sơ để nộp lên Cục SHTT
  • Thay mặt Quý khách hàng nhận toàn bộ các công văn, trả lời, bổ sung và khiếu nại (nếu có).
  • Theo dõi đơn nhãn hiệu, và bàn giao Giấy chứng nhận đăng ký nhãn hiệu cho Quý khách hàng.
