Tra cứu, tìm nhãn hiệu đối chứng. Việc tìm ra đối chứng để đánh giá khả năng phân biệt của đối chứng tìm điợc với các dấu hiệu được mô tả trong đơn đăng ký nhãn hiệu là vô cùng quan trọng.

Đối chứng nhằm đánh giá những nguồn thông tin tối thiểu liên quan đến các yêu cầu bảo hộ, nhằm so sánh và kết luận về tính phân biệt của dấu hiệu được nêu trong đơn. Góp phần đánh giá tính khả thi trong việc đăng ký nhãn hiệu cho hàng hóa, dịch vụ đó.

Những dấu hiệu nào bị xem là trùng hoặc tương tự gây nhầm lẫn với đối chứng sẽ không được đăng ký nhãn hiệu theo quy định của pháp luật Sở hữu trí tuệ. Do đó, đối chứng được xem xét và sàng lọc kĩ càng, nhằm đối chiếu một cách trung thực và khách quan đối với dấu hiệu được nêu trong đơn. Những đối chứng dùng để đánh giá khả năng phân biệt là:

–            Đối với các dấu hiệu chữ bằng Tiếng Việt, cần đánh giá một cách riêng biệt từng từ, cụm từ mà không cần cắt hoặc tách từ đó.

–            Đối với những chữ có nghĩa tiếng Việt, cần tra cứu để tìm ra đối chứng có nghĩa tương tự trong tiếng Anh, tiếng Pháp, từ Hán-Việt, tiếng Nga, tiếng Hán để đánh giá tính tương tự theo ngữ nghĩa.

–           Đối với các dấu hiệu là chữ tự đặt, không có nghĩa đối với Tiếng việt hoặc các ngôn ngữ khác thì cần tìm các đối chứng có các kí tự với tiền tố, hậu tố hoặc tổ hợp từ ở giữa.

–          Đối với các dấu hiệu là hình ảnh, hình vẽ  hoặc chứa các yếu tố hình, cần tra cứu dựa vào bảng phân loại các yếu tố hình của Nhãn hiệu được quy định trong thỏa ước.

–          Đối với các dấu hiệu chữ có nghĩa, hình cụ thể thì đối chứng là hình hoặc chữ có nghĩa tương ứng
