Thứ hai, về nội dung quyền. Quyền tác giả và quyền sở hữu công nghiệp đều có chung một loại quyền là quyền về tài sản mang lại lợi ích kinh tế cho chủ thể được xác lập quyền. Bên cạnh đó quyền tác giả còn bổ sung thêm quyền nhân thân, loại quyền này gắn liền với nhân thân là của người sáng tạo ra tác phẩm để bảo đảm danh dự, uy tín của tác giả gắn với tác phẩm đó.
Thứ ba, về cách thức xác lập quyền. Do những đặc thù riêng nên cách thức xác lập quyền đối với hai loại quyền này không giống nhau. Quyền tác giả sẽ mặc nhiên phát sinh ngay khi tác phẩm được định hình dưới một hình thức vật chất nhất định. Tuy nhiên, pháp luật vẫn đặt ra thủ tục đăng ký bản quyền cho loại quyền này để người sở hữu nó có thể dễ dàng bảo vệ mình khi bị xâm phạm và để thực hiện các loại quyền đối với nó. Cục bản quyền tác giả là cơ quan có thẩm quyền cấp giấy chứng nhận quyền tác giả. Khác với quyền tác giả, quyền sở hữu công nghiệp chỉ được xác lập khi chủ thể đã thực hiện thủ tục đăng ký và được cấp văn bằng bảo hộ. Văn bằng này sẽ do Cục sở hữu trí tuệ là cơ quan có thẩm quyền cấp.
