Tại sao phải đăng ký bản quyền?

Đăng ký bản quyền thủ tục mà một người sau khi sáng tạo ra các tác phẩm thực hiện tại Cục bản quyền tác giả. Theo pháp luật sở hữu trí tuệ, quyền tác giả sẽ được hình thành ngay từ khi tác phẩm được định hình dưới một hình thức vật chất nhất định, vậy tại sao còn cần phải thực hiện thủ tục đăng ký bản quyền.

Mỗi tác phẩm dù là trong lĩnh vực văn học, nghệ thuật hay khoa học đều là sản phẩm trí tuệ mà để tạo ra nó, một người hoặc một tập thể người phải bỏ ra khá nhiều công sức, tâm huyết, tiền bạc và cả thời gian. Do vậy, ngay từ khi tác phẩm được hình thành và được định hình dưới một hình thức vật chất nhất định thì người sáng tạo ra nó sẽ được hưởng quyền tác giả bao gồm quyền nhân thân, quyền tác giả mà không cần phải thực hiện bất cứ hành động nào để đưa sản phẩm đến với công chúng. Tuy nhiên, một vấn đề đặt ra là khi xảy ra tranh chấp ví dụ như có một người nào đó sử dụng, sao chép, sửa tên, nội dung….của tác phẩm mà không có sự xin phép xâm phạm đến quyền tác giả thì điều đầu tiên mà tác giả phải thực hiện để bảo vệ quyền của mình đó là chứng minh quyền sở hữu đối với tác phẩm bằng cách đưa ra tài liệu chỉ rõ thời điểm cụ thể sáng tạo ra tác phẩm. Chẳng hạn như khi tác giả sáng tác ra một bài thơ, một câu chuyện hay viết một bài nghiên cứu và bình luận nào đó và lưu nó vào một tệp trên máy tính. Khi đó, trên máy tính sẽ hiển thị cụ thể ngày giờ mà tác giả lưu tác phẩm và có thể coi đó là thời điểm tác giả hoàn thành tác phẩm. Do vậy, tài liệu này có thể được sử dụng để chứng minh nội dung nêu trên. Tuy nhiên, việc chứng minh này không phải lúc nào cũng dễ thực hiện đặc biệt là đối với những tác phẩm ví dụ như bức tranh, tác phẩm điêu khắc….thì rất khó chứng minh được ngày giờ tạo ra tác phẩm hoặc phải tốn nhiều thời gian, công sức để chứng minh điều này. Khi đó, tác giả rất khó bảo vệ được quyền lợi chính đáng của mình.

Xuất phát từ tình trạng này, cách thức tốt nhất mà tác giả bảo vệ quyền của mình đối với tác phẩm là thực hiện thủ tục đăng ký quyền tác giả tại Cục bản quyền tác giả. Khi đó, tác giả sẽ được cấp giấy chứng nhận đăng ký quyền tác giả và chỉ việc xuất trình giấy tờ này trong trường hợp xảy ra tranh chấp để chứng minh quyền lợi hợp pháp của mình thông qua giấy tờ này.
