            Một nhãn hiệu để đăng ký bảo hộ chỉ mất thời gian khoảng từ 12 đến 14 tháng và để nhãn hiệu này trở nên quen thuộc và trở thành thương hiệu của doanh nghiệp thì phải mất một thời gian khá dài, có thể phải đến tới hàng chục đến hàng trăm năm. Có thể nói, công sức bỏ ra để xây dựng một thương hiệu là rất lớn. Thế nhưng, từ trước đến nay, có không ít thương hiệu Việt bị tư nhân, doanh nghiệp nước ngoài đánh cắp, sử dụng một cách trắng trợn và việc giành lại nó không phải là dễ.

            Thực tiễn cho thấy, có không ít các thương hiệu Việt đã trải qua một quá trình tồn tại, xây dựng lâu dài và trở nên nổi tiếng ở thị thường trong nước nhưng lại bị đăng ký, sử dụng ở nước ngoài bởi tư nhân, doanh nghiệp nước ngoài. Không ít các doanh nghiệp Việt khá lúng túng và bất ngờ khi phát hiện ra thương hiệu mà mình cất công xây dựng từ rất lâu lại đang được sử dụng rộng rãi ở thị trường nước ngoài và lại là một doanh nghiệp nước ngoài hoàn toàn lạ lẫm.

            Tình trạng bị đánh cắp thương hiệu này đã diễn ra khá lâu, ngay từ khi luật sở hữu trí tuệ của Việt Nam vẫn chưa được ban hành, một trong những vụ việc đầu tiên là nhãn hiệu “kẹo dừa Bến Tre” bị đăng ký độc quyền tại Trung Quốc trong năm 1998, năm 2011 lại xuất hiện hàng loạt các thương hiệu khác của các doanh nghiệp Việt Nam như Vinataba, Trung Nguyên, Vifon…bị đăng ký và sử dụng tại nhiều quốc gia. Tình trạng này liên tục tiếp diễn cả sau khi luật Sở hữu trí tuệ đã được ban hành và các nhãn hiệu Việt đã được pháp luật trong nước bảo hộ một cách chặt chẽ. Thực tiễn cho thấy, với sự phát triển của nền kinh tế, các thương hiệu Việt được xây dựng và phát triển và được biết đến rộng rãi hơn, tuy nhiên, cùng với đó lại là tình trạng thương hiệu bị đánh cắp, sử dụng rộng rãi ở thị trường nước ngoài. Trong đó, có thể kể đến một số vụ việc như:

            Thương hiệu nước mắm Phú Quốc của doanh nghiệp Vệt Nam đã bị các công ty tại Thái Lan sử dụng trên các sản phẩm nước mắm của họ xuất khẩu sang Mỹ và Châu Âu. Tại Mỹ công ty Viet Hương Fishauce đã đăng ký nhãn hiệu này tại cơ quan đăng ý có thẩm quyền. Thương hiệu nước mắm nhĩ Phan Thiết cũng rơi vào hoàn cảnh tương tự như nước mắm Phú Quốc khi công ty Kim Seng đóng trụ sở tại Mỹ đăng ký thương hiệu “Nước mắm nhĩ Phan Thiết” tại thị trường này.

Thương hiệu Cà Phê Buôn Ma Thuột mặc dù đã được bảo hộ dưới dạng chỉ dẫn địa lý từ năm 2005 nhưng lại bị đánh cắp sử dụng bởi các doanh nghiệp nước ngoài cụ thể, một công ty tại tỉnh Quảng Đông Trung Quốc đã đăng ký bảo hộ độc quyền trong vòng 10 năm, một công ty của Pháp đăng ký bảo hộ tại hơn 10 quốc gia khác nhau.

Trên đây chỉ là một vài vụ việc điển hình cho tình trạng các thương hiệu Việt bị đánh cắp khá phổ biến như hiện nay. Việc bị đánh cắp thương hiệu như vậy đã gây ra ảnh hưởng không nhỏ đến hình ảnh, danh tiếng cũng như hoạt động sản xuất và đặc biệt là quá trình mở rộng kinh doanh ra ngoài phạm vi quốc gia. Một khi các thương hiệu này đã được đăng ký tại nước ngoài thì sản phẩm gắn mác thương hiệu này của các doanh nghiệp Việt Nam sẽ bị chặn ngay ở cửa khẩu.
