Tranh chấp bản quyền phần mềm – Sự lợi dụng quy định của pháp luật và sự thiếu hiểu biết của tác giả.

Hiện nay, với sự phát triển của nền giáo dục hiện đại, nhiều nhân tài đã xuất hiện mặc dù tuổi đời còn khá trẻ.

Trong thực tiễn không hiếm gặp các trường hợp những đứa trẻ dù đang ngồi trên ghế nhà trường ở các cấp bậc trung học hay phổ thông nhưng đã sáng tạo ra những tác phẩm có giá trị và được công nhận. Tuy nhiên, những “tác giả trẻ” này lại chưa ý thức được quyền của mình đối với những tác phẩm đó. Nhiều tổ chức, cá nhân đã lợi dụng điều này để đánh cắp ý tưởng và quyền sở hữu đối với tác phẩm bằng nhiều chiêu trò khác nhau và khi các “tác giả trẻ” ý thức được quyền của mình thì lại làm phát sinh tranh chấp.

Ta có thể thấy rõ điều này qua một vụ việc tranh chấp điển hình dưới đây:

Trong lần chấm thi sơ khảo olimpic phần mềm tin học trẻ toàn quốc 1996 tại Hà Nội, có hai em học sinh còn đang tuổi trung học phổ thông nhưng đã xây dựng được một phần mềm sinh học dùng cho các cháu mẫu giáo. Trong cuộc thi đó một công ty khác đã cử đại diện trình bày một phần mềm tương tự. Hai phần mềm hoàn toàn giống nhau cả về tư tưởng, cấu trúc chuwogn trình, giao diện, âm thanh và hình ảnh…nhưng phần mềm của hai em học sinh có chút ưu điểm và cải tiến hơn. Qua điều tra cho thấy hai em học sinh đang giữ phần nguồn còn phía công ty chỉ giữ phần các em đã triển khai trước đó vài tháng. Sự thật là hai em học sinh này đã được giám đốc công ty kia thuê để viết phần mềm và hứa sẽ trả thù lao. Bên phía công ty cho rằng vì công ty đã thuê các em viết phần mềm và trả thù lao nên quyền sở hữu phần mềm này thuộc về phía công ty. Tuy nhiên hai em học sinh lại xác nhận rằng các em chưa được nhận tiền nên các em mới là người có quyền đối với phần mềm đó. Thực tế, tranh chấp này xảy ra từ năm 1996 nghĩa là thời điểm luật Sở hữu trí tuệ Việt Nam còn chưa ra đời nên việc giải quyết tranh chấp rất khó khăn. Nếu áp dụng luật Sở hữu trí tuệ 2005 cho tranh chấp này thì quyền của các em học sinh sẽ được đảm bảo bởi “hợp đồng miệng” giữa hai bên trong việc thuê viết bản quyền sẽ không được pháp luật thừa nhận và quyền sở hữu tác phẩm sẽ được xác lập cho hai em học sinh này.

Mặc dù vậy, đến thời điểm hiện nay khi mà luật sở hữu trí tuệ năm 2005 đã có hiệu lực thì tranh chấp này vẫn có thể coi là lời nhắc nhỏ cho các “tác giả trẻ” cũng như người thân của họ chú ý hơn đến việc bảo vệ tác phẩm phần mềm cũng như xác lập hợp đồng với tác tổ chức, cá nhân khác trong việc xây dựng tác phẩm phần mềm.
