Vụ kiện giữa nhạc sĩ Trần Lập và Zing Mp3 – một số vấn đề cần bàn luận (Kỳ 2)

Lời cảnh báo cho những hành vi vi phạm bản quyền của các tác phẩm ghi âm ghi hình.

Vụ kiện giữa nhạc sĩ Trần Lập và Zing Mp3 đã kết thúc chỉ trong vòng một tuần kể từ ngày mở phiên tòa sơ thẩm (từ 3/12/ 2014 – đến 10/12/2014). 

Vụ kiện được giải quyết không phải bằng phán quyết của tòa mà trên cơ sở sự thỏa thuận giữa hai bên với việc rút đơn khởi kiện của phía nguyên đơn. Theo đó, quyền của chủ sở hữu bản ghi âm, tác giả bài hát “Đường đến ngày vinh quang” đã thực sự được bảo vệ.

Có thể thấy, quyền của tác giả, của chủ sở hữu đối với tác phẩm, bản ghi âm, ghi hình đều được pháp luật xác lập, thừa nhận và bảo hộ. Do vậy, bất kỳ cá nhân, tổ chức nào có hành vi vi phạm các quyền này thì đều phải chịu trách nhiệm trước pháp luật. Tuy nhiên, thực tế cho thấy, việc vi phạm các quyền này diễn ra tương đối phổ biến nhưng con số những cá nhân, tác giả của tác phẩm, chủ sở hữu bản ghi âm, ghi hình đứng lên bảo vệ quyền lợi của mình lại rất ít. Có thể nói, nhạc sĩ Trần Lập là một trong số ít người đa thực hiện được điều này. Kết quả là giữa nhạc sĩ Trần Lập và Công ty VNG đã xác lập một bản hợp đồng xác lập quyền cho công ty này việc sử dụng các bản thu âm đã phát hành của bài hát, cùng với đó là cam kết cho phép VNG độc quyền phát hành bản MP3 đối với các ca khúc sáng tác của Trần Lập đã được phát hành và một album mới chuẩn bị phát hành. Theo đó, nhạc sĩ không chỉ bảo vệ được quyền của mình đối với bản ghi âm bài hát đã bị sử dụng, lan truyền trái phép mà còn xác lập được một giao dịch có lợi cho bản thân tác giả cũng như tác phẩm với chính tổ chức đã có hành vi vi phạm.

Có thể nói, vụ kiện giữa nhạc sĩ Trần Lập và Zing MP3 đã đặt ra một mối quan tâm mới không chỉ của những người liên quan mà còn với cả dư luận về vấn đề bảo hộ bản quyền đối với tác phẩm bài hát, bản ghi âm, ghi hình, nhất là trong sự phát triển mạnh mẽ của mạng lưới internet như hiện nay. Trong đó, các tác giả, chủ sở hữu nên đứng lên bảo vệ quyền lợi cho mình trước bất kỳ hành vi vi phạm nào đến bản quyền tác phẩm, bản ghi âm, ghi hình thay vì tâm lý e ngại với các thủ tục hành chính, tố tụng như hiện nay. Bên cạnh đó, vụ kiện cũng là lời cảnh báo đối với những cá nhân, tổ chức có ý định đăng tải, phát sóng… nhằm thu lợi trái phép đối với các bản ghi âm, ghi hình của các sáng tác âm nhạc. Thay vì thực hiện những hành vi vi phạm này thì các tổ chức, cá nhân có thể thỏa thuận với tác giả, chủ sở hữu tác phẩm, bản ghi âm, ghi hình để có quyền phát sóng, truyền tải hợp pháp…và tránh được những trách nhiệm pháp lý có thể sẽ gặp nếu không thỏa thuận trước và không được sự cho phép của tác giả, chủ sở hữu của những đối tượng này.
