Bản án về bản quyền bức ảnh Đà Nẵng hướng tới tương lai của tác giả Mạc Bảo Khánh.

TT – Việc TAND Q.Hải Châu (Đà Nẵng) tuyên phạt Công ty Toàn Cầu Xanh bồi thường cho tác giả Mạc Bảo Khánh 14 triệu đồng vì vi phạm bản quyền nhiếp ảnh là số tiền nhỏ, nhưng đang tạo khích lệ lớn cho vấn đề bảo vệ tác quyền.

Từ Đà Nẵng, nhiếp ảnh gia Mỹ Dzũng tỏ ra rất hồ hởi. Anh là một trong số những nhiếp ảnh gia Đà Nẵng được phía nguyên đơn Mạc Bảo Khánh mời tham dự phiên tòa xử Công ty Toàn Cầu Xanh vi phạm bản quyền bức ảnh Đà Nẵng hướng đến tương lai hôm 12-5.

Mỹ Dzũng cho biết: “Dư luận của anh em nhiếp ảnh gia Đà Nẵng đang rất tốt. Tôi nghĩ bản án này đã thể hiện được khao khát và ao ước của anh em nhiếp ảnh chúng tôi bấy lâu nay trong vấn đề bảo vệ bản quyền. Chúng tôi cảm giác rất vui mừng. Đà Nẵng phải cho những nơi khác thấy mình tiên phong trong việc bảo vệ tác quyền như thế!”.

Phấn khởi cũng là tâm trạng chung của phía nguyên đơn Mạc Bảo Sơn – người chú cũng là người đại diện của sinh viên Mạc Bảo Khánh theo đuổi vụ kiện tụng này.

Khi được hỏi ngoài số tiền bồi thường thì bản án có kèm theo yêu cầu phía bị đơn có lời xin lỗi công khai hay không, ông Mạc Bảo Sơn nói: “Về mặt pháp luật thì lời xin lỗi phải có. Nhưng chúng tôi cũng không cần vì cảm thấy không nên nặng nề quá làm gì. Chúng tôi toại nguyện với bản án của tòa, chỉ muốn xã hội phải minh bạch về vấn đề bản quyền chứ không phải vì tiền hay vấn đề gì khác!”.

Theo lời kể, để theo vụ kiện tụng này, phía ông Mạc Bảo Sơn đã mất 10 tháng để đi đến đích cuối cùng là bảo vệ quyền lợi chính đáng của mình. Bắt đầu từ khi họ phát hiện Công ty TNHH MTV tư vấn giải pháp CNTT Toàn Cầu Xanh (Q.Hải Châu, Đà Nẵng) sử dụng trái phép bức ảnh Đà Nẵng hướng đến tương lai vào tháng 7-2014 và chính thức nộp đơn lên tòa án ngày 30-7-2014.

Ông Sơn kể tòa đã tiến hành ba lần hòa giải. “Lần thứ nhất, bên công ty nói tác giả không có chứng nhận bản quyền, nhưng phía tòa cho rằng tác giả chỉ cần chứng minh nguồn gốc bức ảnh và không có ai tranh chấp là đủ.

Ở lần hòa giải thứ hai, họ nói căn cứ đâu để xác định mức thiệt hại gây ra cho chủ tác phẩm? Tòa yêu cầu chúng tôi phải ứng tiền để lập hội đồng thẩm định có Sở VH-TT&DL, Sở Khoa học – công nghệ, Hội Nhiếp ảnh Đà Nẵng… Hội đồng đã thẩm định mức thiệt hại là 20 triệu đồng.

Ở lần hòa giải thứ ba, họ không chịu nên tòa mới xử. Tất nhiên, khi họ thua cuộc thì tòa sẽ yêu cầu họ hoàn tiền án phí hay chi phí lập hội đồng thẩm định cho chúng tôi” – ông Sơn nói.

Vụ bức ảnh Đà Nẵng hướng đến tương lai là một vụ án rất nhỏ, nhưng sự khích lệ của nó trong ý thức bảo vệ tác quyền đang lan đi rộng rãi.

Một bản án ngoài việc đem lại sự công bằng cho người bị hại còn có ý nghĩa giáo dục, tạo ý thức tôn trọng pháp luật trong xã hội. Từ TP.HCM, nhiếp ảnh gia Vũ Hải Sơn chia sẻ điều đó: “Phải nói dư luận anh em nhiếp ảnh xung quanh tôi rất hoan nghênh bản án như vậy. Tôn trọng bản quyền, công sức sáng tạo phải được coi là ý thức, văn hóa của một xã hội. Ngay cả trên mạng xã hội, bây giờ trang cá nhân đăng ảnh của ai cũng cần ghi rõ nguồn nữa mà!”.
