      Nhãn hiệu và thương hiệu liệu có được thay thế cho nhau? Đăng ký nhãn hiệu hay đăng ký thương hiệu? Một điều rất dễ thấy: Khi chúng ta đề cập đến đăng ký thương hiệu, hầu hết ai cũng biết vì nó là thuật ngữ được sử dụng khá rộng rãi. Tuy nhiên, theo Luật Sở hữu trí tuệ, pháp luật chỉ thừa nhận một khái niệm duy nhất, đó là đăng ký nhãn hiệu (registration of marks). Như vậy, để phù hợp với thuật ngữ pháp lý, bài viết sẽ chỉ sử dụng đăng ký nhãn hiệu mà không đề cập đến đăng ký thương hiệu.

       Nhãn hiệu chỉ được cấp giấy chứng nhận đăng ký khi đơn đăng ký được nộp tại Cục Sở hữu trí tuệ Việt Nam(NOIP – National Office of Intellectual Property of Vietnam) và đáp ứng đủ tiêu chuẩn bảo hộ. Một trong những tiêu chuẩn quan trọng là nhãn hiệu này không được trùng hoặc tương tự gây nhầm lẫn với nhãn hiệu đã được đăng ký trước đó cho cùng sản phẩm, dịch vụ tại Cục sở hữu trí tuệ. Vậy, làm sao để biết được nhãn hiệu mà công ty mình định đăng ký (Signal) có trùng hoặc tương tự với các nhãn hiệu đã được bảo hộ (Trademark)

      Quy trình đăng ký nhãn hiệu được thực hiện cơ bản theo 2 bước sau:

       Bước 1. Tra cứu khả năng bảo hộ nhãn hiệu

     Đây là một bước không bắt buộc nhưng rất cần thiết để đánh giá khả năng đăng ký nhãn hiệu trước khi nộp đơn tại Cục sở hữu trí tuệ. Qua đó, giúp người nộp đơn có thể tiếp tục nộp đơn hay tiến hành thay đổi nhãn hiệu để có thể được cấp giấy chứng nhận đăng ký nhãn hiệu.

       Thời gian tra cứu khả năng bảo hộ nhãn hiệu là khoảng 3 – 5 ngày.

       Bước 2. Đăng ký bảo hộ nhãn hiệu

        Đăng ký bảo hộ nhãn hiệu bao gồm 4 giai đoạn chính:

  • Thẩm định hình thức:

      Đơn đăng ký nhãn hiệu phải được thẩm dịnh hình thức nhằm xác định về mặt hình thức đơn có hợp lệ hay không. Nếu được chấp nhận, Cục sở hữu trí tuệ ra thống báo chấp nhận đơn hợp lệ về mặt hình thức có xác nhận ngày nộp đơn, số đơn, ngày ưu tiên của đơn. Nếu đơn có thiếu sót, Cục sở hữu trí tuệ thông báo dự định từ chối chấp nhận đơn hợp lệ cho người nộp đơn và ấn định thời hạn 01 tháng kể từ ngày thông báo để người nộp đơn có ý kiến hay sửa chữa thiếu sót.

          Thời hạn thẩm định hình thức là 01 tháng kể từ ngày đơn đến Cục sở hữu trí tuệ.

  • Công bố đơn

       Trong vòng 02 tháng kể từ ngày chấp nhận đơn hợp lệ, đơn đăng ký nhãn hiệu sẽ được công bố trên Công báo của Cục để bất kỳ bên thứ ba nào cũng  có thể tiến hành phản đối việc đăng ký đơn này.

  • Thẩm định nội dung

       Việc thẩm định nội dung được tiến hành khi đơn đã được chấp nhận đơn hợp lệ và người nộp đơn đã nộp lệ phí xét nghiệm nội dung theo quy định.

      Thời hạn thẩm định nội dung đơn nhãn hiệu là 09 tháng tính từ ngày đơn đơn đăng ký nhãn hiệu được công bố trên Cục sở hữu trí tuệ về khả năng cấp giấy chứng

  • Công bố và cấp giấy chứng nhân đăng ký nhãn hiệu

      Nếu đơn được chấp thuận, Cục sở hữu trí tuệ Việt Nam sẽ cấp giấy chứng nhận đăng ký nhãn hiệu cho người nộp đơn. Trong trường hợp, đơn đăng ký không được chấp thuẩn, Cục sẽ trả lời bằng văn bản về việc từ chối cấp giấy chứng nhận đăng ký nhãn hiệu cho người nộp đơn biết.
