Nhãn hiệu chứa chỉ dẫn địa lý? Hiện nay, có rất nhiều khu vực, tỉnh thành có những sản phẩm hàng hóa mang đặc trưng riêng của vùng đó mà không thể nhầm lẫn vào đâu được. Cái tên của sản phẩm đó luôn gắn liền và trở thành một biểu tượng không thể thiếu mỗi khi nhắc tới địa danh đó. Những sản phẩm đó được nhà nước công nhận và trở thành một nhãn hiệu gắn với khu vực địa lý nơi mang sản phẩm. Điển hình như: Cơm cháy Ninh Bình, gốm Bát Tràng, nước mắm Phú Quốc…
Chỉ dẫn địa lý được hiểu là dấu hiệu dùng để chỉ sản phẩm có nguồn gốc từ khu vực, địa phương, vùng lãnh thổ hay quốc gia cụ thể và chỉ dẫn địa lý thuộc quyền sở hữu của Nhà nước. Nhà nước trao quyền cho tổ chức, cá nhân sử dụng chỉ dẫn địa lý đó để sản xuất và buôn bán sản phẩm đó ra thị trường. Một tổ chức, cá nhân muốn sử dụng chỉ dẫn địa lý cho sản phẩm có xuất xứ từ khu vực địa lý đó thì phải có sự xin phép của chính quyền địa phương liên quan, tức là UBND các cấp quản lý trọn vẹn lãnh thổ tương ứng cho phép chủ đơn đăng ký thành phần là tên địa lý. Đồng thời, cơ quan, tổ chức được trao quyền quản lý cũng có thể ngăn cấm việc sử dụng chỉ dẫn địa lý theo quy định của pháp luật.
Tuy nhiên, khi nhãn hiệu sử dụng chỉ dẫn địa lý đã được cấp phép cần đảm bảo được rằng: sản phẩm mang chỉ dẫn địa lý phải có xuất xứ từ địa phương, khu vực đó và sản phẩm đó có danh tiếng, đặc tính, chất lượng chủ yếu là do điều kiện tự nhiên của khu vực đó mang lại.
