Vi phạm nhãn hiệu dường như không phải là đề tài mới mẻ, nhưng chưa ngừng nguội đi trong thời buổi đầy rẫy cạnh tranh này. Hiện nay, vấn đề vi phạm nhãn hiệu đang ngày càng nóng lên bởi chính sự bất chấp của nhiều cá nhân, tổ chức “lợi dụng” danh tiếng của nhiều sản phẩm, hàng hóa đã xây dựng thương hiệu từ trước.
Thực tế đã có nhiệu vụ việc bị “phơi bày” ra ánh sáng và bị cơ quan chức năng có thẩm quyền xử phạt, nhưng vẫn chưa là hồi chuông cảnh tỉnh đối với một số đối tượng vi phạm. Mới đây nhất, vụ việc vi phạm sở hữu thương hiệu trà Thái Nguyên đang được dư luận đặc biệt quan tâm. Cơ quan cảnh sát điều tra Công an thành phố Bảo Lộc tỉnh Lâm Đồng vừa quyết định tống đạt khởi tố vụ án gồm hai bị can Phạm Quốc Thái Đạt(1970) và Trần Thị Thu Trang (1973) cùng trú tại xã Lộc Châu, Tp. Bảo Lộc, Lâm Đồng khi tổ chức sản xuất các sản phẩm trà mang nhãn hiệu Thái Nguyên. Nhãn hiệu này đã được bà Nguyễn Thị Liền trú tại Thị trấn Hòa Thạnh, huyện Hòa Thành, tỉnh Tây Ninh đã đăng ký nhãn hiệu hàng hóa và được Bộ khoa học công nghệ cấp giấy chứng nhận sở hữu.

Theo như thông tin tìm hiểu được, từ tháng 6/2012 đến cuối năm 2014, hai bị can trên đã sản xuất và bán ra thị trường gần 151 tấn trà mang nhãn hiệu Thái Nguyên và thu được 5 tỉ đồng. khi không có giấy chứng nhận đăng ký nhãn hiệu. Thực tế, ông Đạt có nộp hồ sơ đăng ký nhãn hiệu trà Thái Nguyên vào 6/2012 nhưng đến nay chưa được cấp giấy chứng nhận. Sau khi điều tra, công an đã thu giữ 299 bao trà thành phẩm mang nhãn hiệu Thái Nguyên có trọng lượng 5.681kg, 8 bao trà rời nhãn hiệu Thái Nguyên.
Sau khi nhận được đơn kiện của bà Nguyễn Thị Liền về hành vi vi phạm của hai bị can trên, ngày 11/02/2015, Viện Khoa học sở hữu trí tuệ có văn bản xác định nhãn hiệu trà Thái ngyên hình quả bầu, hình em bé, hình ông tiên là vi phạm nhãn hiệu của bà Nguyễn Thị Liền đã được đăng ký trước đó. Hiện vụ việc đang tiếp tục được điều tra và làm rõ, tuy nhiên theo quan điểm cá nhân, hành vi của hai bị can trên là vi phạm nghiêm trọng về quyền sở hữu trí tuệ đã được pháp luật bảo hộ. Bà Nguyễn Thị Liền đã được Cục sở hữu trí tuệ cấp văn bằng bảo hộ đối với nhãn hiệu trà Thái Nguyên và Bộ khoa học công nghệ cấp văn bằng bảo hộ kiểu dáng công nghiệp đối với cách thức thể hiện hình dáng, bao bì sản phẩm trà. Việc hai bị can trên sử dụng nhãn hiệu đã được cấp văn bằng bảo hộ mà không có sự đồng ý của chủ sở hữu nhãn hiệu là bà Liền trong hơn 02 năm là vi phạm pháp luật.
Vụ việc lần này cũng chính là một điển hình cho những vi phạm nhãn hiệu trong thời gian gần đây. Hình như các cá nhân, tổ chức quên mất đi cái “quyền” được pháp luật cho phép và không cho phép. Vì mục đích lợi nhuận riêng mà sẵn sàng gạt bỏ đi những quy định đã được pháp luật thừa nhận và bảo hộ. Nếu muốn kinh doanh một cách hợp pháp, các chủ đầu tư nên xây dựng cho mình một thương hiệu để phát triển bền vững mà không phải “ăn cắp không trả tiền”. Vụ việc hiện đang được điều tra nhưng tin rằng, những người vi phạm sẽ bị trả giá thích đáng cho hành vi sai trái của mình.

While I’m sure it’ll pick up a little over the weekend the dictator will underperform because (a) The avengers will crush everything in it’s path (b) People are sick of sacha baron cohen after the trainwreck that was Bruno (c) People are sick of this dictator character before his film even came out (d) It’s incredibly unclear from the trailer and marketing as to what the plot is meant to be and (e) there’s something a little off about a film about a tyrannical dictator that I imagine won’t fly well in the US.
