Đăng ký sáng chế tại Liên minh Châu Âu (EU) là việc làm rất cần thiết của các doanh nghiệp Việt Nam khi muốn tiến vào thị trường EU đầy tiềm năng.

Để giải đáp những thắc mắc về các thủ tục pháp lý khi đăng ký sáng chế tại EU, Công ty Luật Quốc dân (NACI Law) xin giới thiệu trình tự thủ tục và dịch vụ đăng ký sáng chế tại Liên minh Châu Âu (EU) như sau:

Trình tự thủ tục đăng ký sáng chế tại Liên minh Châu Âu (EU).

Muốn đăng ký bảo hộ sáng chế tại EU thì trước tiên sáng chế đó cần được xem xét có thỏa mãn đủ các điều kiện để được bảo hộ theo pháp luật sáng chế tại đây hay không.

Luật sở hữu trí tuệ của EU quy định ba điều kiện để một sáng chế được bảo hộ, đó là:

  • Tính mới.
  • Tính sáng tạo và
  • Khả năng áp dụng công nghiệp

Thẩm định viên của Phòng sáng chế Châu Âu (EPO) sẽ tiến hành thẩm định và quyết định xem sáng chế đăng ký có thỏa mãn các điều kiện trên không. Chủ sở hữu sáng chế có thể nhờ các đại diện sở hữu trí tuệ để giúp mình trong việc chuẩn bị hồ sơ đăng ký và theo đuổi đơn tại EPO.

Hồ sơ đăng ký sáng chế:

  • Đơn đăng ký sáng chế;
  • Bản mô tả sáng chế;
  • Bản vẽ sáng chế;
  • Tài liệu chứng minh hưởng quyền ưu tiên (Đối với các đơn có yêu cầu hưởng ưu tiên).

Quy trình làm việc của NACI Law:

  • Tra cứu và đánh giá khả năng bảo hộ sáng chế tại Liên minh Châu Âu (EU);
  • Tư vấn về các thủ tục pháp lý và đại diện trong việc nộp đơn xin cấp bằng độc quyền sáng chế tại Liên minh Châu Âu (EU);
  • Làm thủ tục xin gia hạn và duy trì hiệu lực văn bằng bảo hộ tại Liên minh Châu Âu (EU);
  • Thẩm định và đánh giá hiệu lực của văn bằng bảo hộ sáng chế đã được cấp tại Liên minh Châu Âu (EU);
  • Thẩm định và đánh giá khả năng xâm phạm, đồng thời phối hợp với các cơ quan chức năng có thẩm quyền trong việc bảo vệ các quyềnn của khách hàng đối với sáng chế được bảo hộ tại Liên minh Châu Âu
