Tại sao phải đăng ký bản quyền cho cho tác phẩm? Một câu hỏi khá đơn giản nhưng không phải ai cũng thực hiện theo nó. Bản quyền là cách gọi khái quát, đơn giản về quyền của tác giả hoặc chủ sở hữu đối với các tác phẩm, có thể là tác phẩm nghệ thuật hay khoa học. Đây đều là các sản phẩm của trí tuệ, xuất phát từ tính chất đặc biệt của nó, ngay khi các tác phẩm này được định hình pháp luật đã trao quyền cho người đã sáng tạo ra nó.
Vậy tại sao pháp luật lại đặt ra thủ tục đăng ký bản quyền cho tác phẩm?
Việc ban hành ra một quy định pháp luật không phải đơn giản mà phải trải qua một quá trình nghiên cứu, soạn thảo và được quốc hội thông qua. Do vậy, quy định về thủ tục đăng ký bản quyền cho tác phẩm phải xuất phát từ sự cần thiết, quan trọng của nó. Cụ thể là gì? Giấy chứng nhận đăng ký quyền tác giả là là giấy tờ xác thực quyền tác giả đối với tác phẩm, trong đó sẽ xác định rõ thời gian tác phẩm được hoàn thành. Giấy tờ này sẽ là bằng chứng hữu hiệu để tác giả bảo vệ quyền của mình trước tòa trong trường hợp xảy ra tranh chấp. Nếu như không thực hiện thủ tục này, việc chứng minh thời điểm hoàn thành tác phẩm là không dễ, nhất là đối với những tác phẩm như điêu khắc, mỹ thuật …vì những tác phẩm này ít khi được lưu lại thời điểm hoàn thành cụ thể. Thậm chí có trường hợp tác giả thực sự không chứng minh được thời điểm hoàn thành tác phẩm nên đã để mất quyền sở hữu vào tay người khác.
Cách tốt nhất để bảo hộ bản quyền tác phẩm là gì?
Câu trả lời đó là thực hiện thủ tục đăng ký cấp giấy chứng nhận quyền tác giả tại Cục bản quyền tác giả Việt Nam.
