Tên doanh nghiệp và tên nhãn hiệu liệu có khác nhau hay không?

        Nhắc đến Công ty TNHH tư vấn Quốc Dân, người ta nhận định đó là tên của một doanh nghiệp hay là tên nhãn hiệu của dịch vụ tư vấn luật. Liệu tên doanh nghiệp và tên nhãn hiệu liệu có giống nhau? Nếu không, chúng khác nhau ở những điểm nào?

         Dựa vào quá trình hoạt động nghiên cứu pháp luật cũng như tư vấn luật, tôi xin khẳng định tên doanh nghiệp và tên nhãn hiệu là hai phạm trù khác nhau.

         Đầu tiên, về khái niệm. Nhãn hiệu là dấu hiệu của sản phẩm, dịch vụ để phân biệt các sản phẩm dịch vụ của các cá nhân, tổ chức kinh doanh khác nhau. Còn tên doanh nghiệp là tên được ghi nhận trogn Giấy chứng nhận đăng ký kinh doanh. Ví dụ như Công ty TNHH tư vấn Quốc Dân là tên doanh nghiệp vì nó được ghi nhận tại giấy phép kinh doanh số 0106246204 cấp ngày 01/8/2013.

       Thứ hai, về đối tượng được đề cập đến. Nhãn hiệu thì gắn liền với sản phẩm, dịch vụ, còn tên doanh nghiệp gắn liến tên của công ty. Ví dụ khi ta nhắc đến nhãn hiệu Bitis, chúng ta nhắc đến giầy dép chứ không phải công ty sản xuất giầy dép, còn khi nhắc đến Công ty TNHH Sam Sung Electronics Viêt Nam, người ta hình dung đến một công ty sản xuất điện thoại, máy tính, ti vi…. Một ví dụ khác, Công ty Honda Việt Nam là tên doanh nghiệp, còn nhãn hiệu mà công ty này đăng ký cho sản phẩm, dịch vụ, hàng hóa của họ chính là Wave, Air Blade, SH, Dream…

       Thứ ba, về chức năng, nhãn hiệu được dùng để phân biệt các sản phẩm, dịch vụ của các chủ thể kinh doanh khác nhau, còn tên doanh nghiệp chỉ đơn giản là phân biệt chính xác doanh nghiệp này với doanh nghiệp khác trong hoạt động kinh doanh.

       Trên đây là một số điểm khác biệt cơ bản giữa tên doanh nghiệp và nhãn hiệu để các bạn lưu ý khi sử dụng các thuật ngữ

Theatrical designers can clearly make the case that the fixtures are not “Installed” (to quote the text from the bill).
