Đăng ký độc quyến sáng chế. Xã hội ngày càng phát triển, ngành nghề trí thức càng được ưa chuộng, sản phẩm cá nhân mang tính ứng dụng cao càng được coi trọng và có ví thế tối thượng trong nền kinh tế hội nhập. Vì thế, việc đăng ký độc quyền sáng chế được quan tâm hơn bao giờ hết.
Theo quy định của pháp luật, trình tự đăng ký sáng chế thực hiện theo các bước sau đây:
Bước 1: Tiếp nhận đơn
Cá nhân, tổ chức có thể gửi đơn đển Cục sở hữu trí tuệ tại Hà Nội hoặc 2 văn phòng đại diện của Cục tại TP. Hồ Chí Minh và Đà Nẵng.
Đơn đăng ký có thể nộp theo hai cách:
- Cách 1: Gửi gián tiếp qua đường bưu điện tới cơ quan nhà nước có thẩm quyền
- Cách 2: Gửi đơn trực tiếp đến cơ quan nhà nước có thẩm quyền
Bước 2: Thẩm định hình thức đơn
Việc thẩm định đơn này sẽ phải tuân thủ các nguyên tắc nhất định trong thời hạn 15 ngày kể từ ngày nhận đơn để xác định tính hợp lệ của đơn.
Bước 3: Công bố đơn
Nếu những đơn hợp lệ, Cục sở hữu trí tuệ sẽ ra thông báo chấp thuận và được công bố trên Công báo sỡ hữu công nghiệp.
Bước 4: Thẩm định nội dung đơn
Thẩm định nội dung đơn nhằm để xem xét, đánh giá khả năng được bảo hộ của đối tượng nếu trong đơn theo các điều kiện bảo hộ.
Bước 5: Ra quyết định cấp hoặc từ chố cấp văn bằng bảo hộ
Nếu đối tượng trong đơn đáp ứng được các yêu cầu về bảo hộ, Cục sở hữu trí tuệ sẽ ra quyết định cấp văn bằng bảo hộ, ghi nhận vào Sổ đăng ký quốc gia về sở hữu công nghiệp và công bố trên Công bảo Sở hữu trí tuệ trong thời hạn 18 tháng.
