        Nhãn hiệu liên kết (Integrated marks) là các nhãn hiệu do cùng một chủ thể đăng ký, trùng hoặc tương tự nhau dùng cho sản phẩm, dịch vụ cùng loại hoặc tương tự nhau hoặc có liên quan với nhau.

      Theo đó, nhãn hiệu liên kết sẽ bao gồm từ hai sản phẩm, dịch vụ trở lên với những đặc điểm cơ bản sau:

  • Đặc điểm về chủ thể: Các nhãn hiệu này phải do cùng một chủ thể đăng ký thì mới được coi là nhãn hiệu liên kết.
  • Đặc điểm về nhãn hiệu: Bên cạnh, cùng một chủ thể đăng ký, các nhãn hiệu được coi là nhãn hiêu liên kết phải thỏa mãn điều kiện là Các nhãn hiệu này có dấu hiệu trùng hoặc tương tự nhau. “Trùng” được hiểu là hoàn toàn giống nhau về cả nội dung và hình thức, “tương tự” có nghĩa là giống nhau về cả mặt hình thức và nội dung nhưng có điểm khác biệt cụ thể mà có thể nhận ra được bằng tên gọi, công dụng, tính năng của sản phẩm, dịch vụ đó.
  • Đặc điểm về sản phẩm, dịch vụ: Các nhãn hiệu này phải có liên quan tới nhau về mẫu nhãn hiệu và nhóm ngành sản phẩm dịch vụ cung cấp.

        Ví dụ cụ thể cho nhãn hiệu liên kết: Các dòng sản phẩm của Honda về xe máy Wave bao gồm: Wave, Wave RX, Wave SX… Nhưng tên nhãn hiệu này được gọi là nhãn hiệu liên kết vì nó đáp ứng được ba điều kiện: Do cùng chủ thể là Hãng Hoanda đăng ký, các sản phẩm này đều có tính năng cơ bản tương tự nhau và cùng nằm trong chuỗi sản phẩm về xe Wave.

       Như vậy, một doanh nghiệp đã đăng ký một nhãn hiệu nào đó cho sản phẩm, dịch vụ của mình thì có quyền đăng ký nhãn hiệu liên kết nếu đáp ứng hai điều kiện còn lại.  Các doanh nghiệp cũng cần chú ý trong trường hợp nộp đơn đăng ký các nhãn hiệu liên kết, nếu yếu tố liên kết là nhãn hiệu, người nộp đơn phải chỉ rõ nhãn hiệu nào là nhãn hiệu cơ bản; nếu yếu tố liên kết là hàng hóa, dịch vụ, thì phải chỉ rõ hàng hóa, dịch vụ nào là cơ bản. Nếu không thì tất cả nhãn hiệu và các hàng hóa, dịch vụ sẽ bị coi là độc lập với nhau.

       Mục đích của việc đăng ký nhãn hiệu liên kết là để ngăn chặn bên thứ bai đăng ký những nhãn hiệu tương tự với nhãn hiệu mà doanh nghiệp đã được cấp văn bằng bảo hộ. Chính vì vậy, các doanh nghiệp Việt Nam cũng nên quan tâm đến việc đăng ký nhãn hiệu liên kết để bảo vệ quyền và lợi ích của doanh nghiệp mình,t ranh tình trạng các doanh nghiệp khác có hành vi vi phạm quyền sở hữu trí tuệ đối với nhãn hiệu trong tương lai.
