Được biết, Nhãn hiệu “D’art Chocolate” đã được Cục sở hữu trí tuệ cấp văn bằng số 202256 cho Công ty cổ phần thương mại Elan & Co có địa chỉ ở 23 -25 Đường 22 KDC Bình Phú, Phường 11, Quận 6, TP. Hồ Chí Minh. Trong thời gian gần đây, công ty này phát hiện được hành vi ăn cắp nhãn hiệu đến từ bà Trần Thị Vỹ Trúc và ông Trần Tuấn Anh – Giám đốc công ty TNHH Elan, có địa chỉ ở 166A Trần Hưng Đạo, phường Nguyễn Cư Trinh, Quận 1, TP. Hồ Chí Minh trong việc làm nhái các mặt hàng mang nhãn hiệu D’art Chocolate của công ty Cổ Phần Thương mại Elan & Co.
Phía đại diện công ty Elan & Co cho hay: “Từ khi thành lập từ tháng 8/2014 Công ty TNHH Elan đã sử dụng mẫu nhãn hiệu D’art Chocolate in trên tất cả các bao bì sản phẩm, name card của nhân viên, trên bảng hiệu của trụ sở công ty Elan tại 166A Trần Hưng Đạo để kinh doanh thu lợi nhuận”. Ngoài ra, họ cho biết thêm: “Thậm chí, trên hóa đơn công ty này còn sử dụng nhãn hiệu đã được cấp bằng độc quyền của công ty chúng tôi để in trên hóa đơn Giá trị gia tăng, trên hóa đơn bán lẻ hàng hóa”, thương hiệu này còn được bên vi phạm sử dụng trên các website chính thức, facebook làm ảnh hưởng đến không nhỏ đến chủ sở hữu nhãn hiệu.
Nhận thấy, hành vi trên đã vi phạm nghiêm trọng đến quy định của pháp luật sở hữu trí tuệ, vi phạm Điều 213 Luật SHTT về hàng hóa giả mạo về sở hữu trí tuệ và TTLT số 01/2008/TTLT – TANDTC-VKSNDTC-BCA-BTP ngày 29/02/2008 thì hành vi trên đã có dấu hiệu xâm phạm quyền sở hữu công nghiệp theo Điều 171 BLHS. Những hành vi như thế này, cần được xử lý một cách nghiêm minh để bảo vệ một cách tốt nhất quyền và lợi ích chính đáng của chủ thể. Lấy đó làm gương cho những người còn có ý định “ăn cắp” công sức của người khác. Từ đó cũng cho thấy, đăng ký bảo hộ thương hiệu cho các sản phẩm, dịch vụ của mình là cách thức hữu hiệu để chủ thể tự mình bảo vệ được quyền lợi cho chính mình.
Để đăng ký bảo hộ thương hiệu trên toàn quốc, cần cung cấp cho TRUNG TÂM THƯƠNG HIỆU những thông tin sau:
- Giấy ủy quyền (mẫu do Trung tâm thương hiệu cấp);
- Mẫu nhãn hiệu;
- Danh mục sản phẩm, dịch vụ mang nhãn hiệu;
- Thông tin người nộp đơn.
