Tác phẩm nhiếp ảnh và quyền tác giả:

Trong thời đại ngày nay, cùng với sự phát triển của công nghệ kỹ thuật hiện đại, bất kỳ ai cũng có thể ghi lại hình ảnh của thế giới quan xung quanh mình trên một phương tiện bắt sáng hoặc trên một phương tiện nào đó mà tác phẩm được tạo ra bằng nhiều phương pháp khác nhau. Tất cả những hình ảnh được ghi lại đó được định nghĩa là tác phẩm nhiếp ảnh.

Trong cuộc sống thường ngày, bạn có thể đã không ít lần sáng tạo ra cho mình những tác phẩm nhiếp ảnh.Chỉ cần một chiếc điện thoại có chức năng chụp ảnh, bạn đã có thể ghi lại những hình ảnh của cảnh sắc thiên nhiên, của môi trường sống xung quanh…mà bạn thích. Đó chính là các tác phẩm nhiếp ảnh, là đối tượng của quyền tác giả và được pháp luật bảo hộ ngay từ khi nó được hình thành. Tuy nhiên, để một tác phẩm nhiếp ảnh thực sự có giá trị và có thể sử dụng và mang lại những lợi ích nhất định thì người sáng tạo ra nó mang cả tâm huyết, thời gian và công sức của mình để lựa chọn và ghi lại những hình ảnh đáng giá. Do vậy, bản quyền của tác phẩm nhiếp ảnh cũng được bảo hộ như các loại hình nghệ thuật khác với các quyền cụ thể là:

Quyền nhân thân bao gồm:

–          Đặt tên cho tác phẩm;

–          Đứng tên thật hoặc bút danh trên tác phẩm; được nêu tên thật hoặc bút danh khi tác phẩm được công bố, sử dụng;

–          Công bố tác phẩm hoặc cho người khác công bố tác phẩm;

–          Bảo vệ sự toàn vẹn của tác phẩm, không cho người khác sửa chữa, cắt xén hoặc xuyên tạc tác phẩm dưới bất kỳ hình thức nào gây phương hại đến danh dự và uy tín của tác giả .

Quyền về tài sản bao gồm:

–          Làm tác phẩm phái sinh;

–          Biểu diễn tác phẩm trước công chúng;

–          Sao chép tác phẩm;

–          Phân phối, nhập khẩu bản gốc hoặc bản sao tác phẩm;

–          Truyền đạt tác phẩm đến công chúng bằng các phương tiện kỹ thuật;
