Thời hạn bảo hộ bản quyền tác giả. Không phải bất kỳ một tác phẩm nào khi được ra đời đều được bảo hộ quyền tác giả một cách vô thời hạn. Còn tùy thuộc vào loại tác phẩm mà thời hạn bảo hộ của chúng là khác nhau.

Đối với các quyền nhân thân bao gồm: quyền đặt tên; đứng tên thật hoặc bút danh trên tác phẩm, được nêu tên thật hoặc bút danh khi tác phẩm được công bố, sử dụng; bảo vệ sự toàn vẹn của tác phẩm, không cho người khác sửa chữa, cắt xén hoặc xuyên tạc dưới mọi hình thức nào gây phương hại đến danh dự và uy tín của tác giả  thì có thời hạn bảo hộ là vô thời hạn.

Các tác phẩm điện ảnh, nhiếp ảnh, sân khấu, mỹ thuật ứng dụng, tác phẩm khuyết danh có thời hạn bảo hộ 10 năm kể từ khi tác phẩm đó được công bố lần đầu tiên.

Các tác phẩm ngoài các tác phẩm đã nêu trên có thời hạn bảo hộ suốt cuộc đời tác giả và 50 năm tiếp theo sau khi tác giả chết. Nếu mà tác phẩm đó có đồng tác giả thì thời hạn bảo hộ sẽ được tính từ 50 năm tiếp theo sau khi tác giả cuối cùng chết.

Các thời hạn trên chấm dứt vào 24h ngày 31 tháng 12 của năm chấm dứt bảo hộ quyền tác giả đó.
