Có thể dùng kiểu dáng công nghiệp có ở nước khác không. Kiểu dáng công nghiệp là hình dáng bên ngoài của sản phẩm bao gồm đường nét, hình khối, màu sắc hoặc sự kết hợp giữa các yếu tố này. Theo đó, mỗi sản phẩm khi được mang ra thị trường sẽ mang một kiểu dáng riêng biệt khác nhau.
Trong quá trình hoạt động sản xuất kinh doanh, các tổ chức cá nhân có thể bắt gặp nhiều kiểu dáng được thiết kế đẹp mắt ở thị trường nước ngoài và muốn sử dụng kiểu dáng này cho sản phẩm của mình. nhưng điều này là không thể. Việc sử dụng nó sẽ dẫn đến những rắc rối về mặt pháp lý trong lĩnh vực sở hữu trí tuệ.
Cụ thể hơn, đối với vấn đề sử dụng hay đăng ký kiểu dáng công nghiệp, doanh nghiệp sẽ không thể thực hiện thủ tục này nếu kiểu dáng công nghiệp đã được đăng ký hoặc công bố tại Việt Nam hoặc ở nước ngoài. Bởi một trong những điều kiện để đăng ký bảo hộ kiểu dáng công nghiệp là đảm bảo được tính mới nghĩa là kiểu dáng công nghiệp được sử dụng hoặc tiến hành đăng ký phải khác với các kiểu dáng đã được đăng ký hoặc được bộc lộ công khai trước đó kể cả ở phạm vi trong nước và trên thế giới.
Theo đó, trong trường hợp các dữ liệu tại Cục sở hữu trí tuệ cho thấy, kiểu dáng công nghiệp chưa được công bố hay được đăng ký bảo hộ tại Việt Nam hay bất cứ quốc gia nào khác thì kiểu dáng công nghiệp này vẫn có thể được đăng ký bảo hộ. Tuy nhiên, việc bảo hộ này sẽ bị chấm dứt nếu có một tổ chức hoặc cá nhân nào đó phát hiện và chứng minh được kiểu dáng công nghiệp này đã được sử dụng hoặc đăng ký ở quốc gia khác.
