Nộp đơn đăng ký nhãn hiệu tại Thành phố Hồ Chí Minh. Văn phòng đại diện Cục sở hữu trí tuệ tại Tp. Hồ Chí Minh là một chi nhánh trực thuộc Cục sở hữu trí tuệ Việt nam. Chi nhánh này ra đời đã góp phần hỗ trợ Cục sở hữu trí tuệ trong việc xác lập, bảo hộ và thực thi quyền sở hữu trí tuệ tại khu vựa phía Nam.

Đặc thù chi nhánh này là các chủ thể tiến hành đăng ký quyền sở hữu công nghiệp đều có thể nộp đơn trực tiếp tại văn phòng đại của Cục. Tuy nhiên, văn phòng đại diện này chỉ có quyền tiếp nhận đơn, còn việc xử lý và thẩm định những nội dung chính quan trọng trong đơn đăng ký thuộc thẩm quyền của Cục sở hữu trí tuệ đóng ở Hà Nội giải quyết. Điều đó lý giải rằng, để giảm thiểu một số thủ tục rườm rà mà nhiều chủ thể có địa chỉ tại khu vực phía Nam có nhu cầu đăng ký bảo hộ quyền sở hữu công nghiệp đều chọn cách thức nộp đơn trực tiếp tại văn phòng Cục sở hữu trí tuệ ở Hà Nội.

Mỗi chủ thể khi tham gia hoạt động sản xuất kinh doanh trên thị trường đều đăng ký cho mình một nhãn hiệu, để trở thành dấu hiệu riêng phân biệt hàng hóa, dịch vụ của mình với hàng hóa, dịch vụ của chủ thể khác. Việc đăng ký nhãn hiệu giúp các Doanh nghiệp, chủ sở hữu nhãn hiệu bảo đảm được những độc quyền nhất định mà pháp luật đã trao cho, bảo vệ quyền lợi cho họ khi có những tranh chấp xảy ra liên quan đến nhãn hiệu hàng hóa trên cơ sở cấp văn bằng bảo hộ của cơ quan nhà nước có thẩm quyền. Pháp luật sở hữu trí tuệ Việt Nam đã tạo điều kiện cho các chủ thể có quyền nộp đơn đăng ký quyền sở hữu công nghiệp tại các văn phòng đại diện của Cục..

Việc đăng ký nhãn hiệu tại Việt nam có thủ tục không quá phức tạp, thời hạn để được cấp văn bằng bảo hộ cho nhãn hiệu là từ 12-14 tháng. Hồ sơ đăng ký nhãn hiệu tại Cục sở hữu trí tuệ chi nhánh Thành phố Hồ Chí Minh bao gồm

–          Tờ khai (theo mẫu);

–          Mẫu nhãn hiệu;

–          Tài liệu, mẫu vật, thông tin thể hiện đối tượng sở hữu công nghiệp được đăng ký;

–          Giấy ủy quyền nộp đơn (nếu đơn nộp thông qua đại diện);

–          Đơn đăng ký nhãn hiệu tập thể, nhãn hiệu chứng nhận còn phải có Quy chế sử dụng nhãn hiệu tập thể/Quy chế sử dụng nhãn hiệu chứng nhận; Bản thuyết minh về tính chất, chất lượng đặc trưng của sản phẩm mang nhãn hiệu;

–          Chứng từ nộp phí, lệ phí.

Phạm vi dịch vụ của công ty Luật Quốc Dân:

  • Tư vấn cho KHÁCH HÀNG về thủ tục và thời gian tiến hành đăng ký.
  • Tra cứu sơ bộ (miễn phí) giúp KHÁCH HÀNG đánh giá được khả năng bảo bộ của nhãn hiệu.
  • Tiến hành soạn thảo hồ sơ để nộp lên Cục Sở hữu trí tuệ Việt Nam.
  • Thay mặt KHÁCH HÀNG nhận toàn bộ công văn, trả lời công văn từ Cục Sở hữu trí tuệ Việt Nam.
  • Theo dõi đơn nhãn hiệu, bàn giao Giấy chứng nhận đăng ký nhãn hiệu cho KHÁCH HÀNG (nếu có)
