Bước 1: thẩm định về mặt hình thức
Thời gian thực hiện là 1 tháng kể từ ngày nộp đơn. Mục đích của giai đoạn này là kiểm tra về mặt hình thức của đơn bao gồm số lượng tài liệu cần có trong đơn, hình thức tài liệu và nội dung tài liệu có đảm bảo đúng yêu cầu mà pháp luật quy định không. Trên cơ sở xem xét những yêu cầu này, Cục sở hữu sẽ xác định đơn đăng ký là hợp lệ hoặc không hợp lệ. Trong trường hợp đơn được xác định là không hợp lệ thì Cục sẽ ra thông báo dự định từ chối chấp nhận đơn và đưa ra yêu cầu cần sửa đổi bổ sung đối với đơn để người nộp đơn thực hiện trong một thời hạn nhất định.
Bước 2: Công bố đơn hợp lệ.
Trong trường hợp đơn đăng ký kiểu dáng công nghiệp là hợp lệ thì sẽ được công bố trên công báo của Cục sở hữu trí tuệ. Thời hạn công bố đơn hợp lệ được xác định như sau: trong trường hợp đơn đăng ký có ngày ưu tiên thì thời hạn được xác định là tháng thứ 19 kể từ ngày ưu tiên, nếu không có ngày ưu tiên thì thời hạn này được xác định kể từ ngày nộp đơn. Thời hạn này có thể được tính là 2 tháng kể từ thời điểm chấp nhận đơn hợp lệ, tùy theo ngày nào muồn hơn. Trong trường hợp đơn đăng ký sáng chế có yê cầu công bố sớm hơn thì sẽ được ông bố trong thời hạn 2 tháng kể từ ngày nhận được yêu cầu này hoặc kể từ ngày chấp nhận đơn hợp lệ, tùy theo ngày nào muôn hơn.
Bước 3: Yêu cầu thẩm định nội dung đơn
Khi đơn đã được công bố trên công báo của Cục sở hữu công nghiệp thì người nộp đơn hoặc người thứ ba phải nộp đơn yêu cầu thẩm định nội dung trong thời hạn 42 tháng kể từ ngày nộp đơn đới với đơn yêu cầu cấp bằng độc quyền sáng chế và 36 tháng đối với đơn yêu cầu cấp bằn độc quyền giải pháp hữu ích và nộp phí tra cứu, phí thẩm định nội dung. Trong trường hợp có lý do chính đáng thì thời hạn này có thể kéo dài thêm 6 tháng.
Nếu trong thời hạn trên, người nộp đơn hoặc người thứ ba không nộp đơn yêu cầu thẩm định nội dung thì sẽ bị coi như là đã rút đơn tại thời điểm hết hạn.
Hình thức của yêu cầu này phải được thực hiện theo mẫu 03-YCTĐ quy định tại phụ lục B thông tư 01/2007/TT-BKHCN hoặc thể hiện trong thời hạn đăng ký sáng chế.
Bước 4: Thẩm định nội dung
Thời hạn thẩm định nội dung được xác định là 18 tháng kể từ ngày nhận được yêu cầu thẩm định nội dung (Nếu yêu cầu này nộp sau ngày công bố đơn) hoặc kể từ ngày công bố đơn (nếu yêu cầu đó nộp trước ngày công bố đơn.
Mục đích của giai đoạn này là kiểm tra khả năng cấp văn bằng bảo hộ của đối tượn được nêu trong đơn.
