Yêu cầu đối với đơn đăng ký sáng chế. Các giải pháp kỹ thuật dưới dạng sản phẩm hoặc quy trình ứng dụng các quy luật tự nhiên để giải quyết một vấn đề nào đó được gọi là sáng chế. Quyền sở hữu sáng chế đối chỉ được bảo hộ khi đã thực hiện thủ tục đăng ký và cấp văn bằng bằng bảo hộ.
Đơn đăng ký cấp văn bằng bảo hộ sáng chế cần có đủ các tài liệu sau:
- Tờ khai đăng ký sáng chế được làm theo mẫu 01-SC Phụ lục A thông tư 01/2007/TT – BKHCN (02 bản)
- Bản mô tả sáng chế trong đó có phạm vi bảo hộ sáng chế (02) bản
- Chứng từ nộp phí, lệ phí.
Đơn đăng ký cấp văn bằng bảo hộ sáng chế cần đáp ứng đủ các yêu cầu sau:
- Mỗi đơn đăng ký chỉ yêu cầu cấp một văn bằng bảo hộ.
- Tài liệu của đơn viết bằng tiếng Việt, tài liệu làm bằng ngôn ngữ khác phải dịch ra tiếng Việt.
- Tài liệu của đơn phải trình bày theo hình thức: chiều dọc của khổ giấy A4, cách lề 2cm ở cả 4 phía. Yêu cầu này không áp dụng với các tài liệu bổ trợ mà nguồn gố tài liệu không nhằm để đưa vào đơn
- Tài liệu có mẫu thì phải lập theo mẫu và điền đầy đủ thông tin
- Tài liệu có nhiều trang thì phải đánh số thứ tự bằng chữ số Ả – rập
- Tài liệu phải rỗ ràng, không tẩy xóa. Trong trường hợp có sai sót thì người nộp đơn có thể sửa chữa nhưng phải có chữ ký xác nhận (có đóng dấu nếu có)
- Không sử dụng tiếng địa phương, từ tụ tạo, từ hiếm trong đơn, các ký hiệu khác, phông chữ phải theo tiêu chuẩn Việt Nam
- Đơn có thể kèm theo tài liệu bổ trợ là vật mang dữ liệu điện tử.
- Sáng chế phải được phân loại theo bảng phân loại quốc tê.
