Cơ quan chức năng không thống nhất – đòi lại công bằng cho Nhãn hiệu. Cơ quan hành chính Nhà nước đóng vai trò quan trọng trong việc điều chỉnh những quan hệ phát sinh trong lĩnh vực hành chính. Các cơ quan này thay mặt Nhà nước chịu trách nhiệm và xử lý những công việc liên quan trực tiếp đến lĩnh vực thuộc sự quản lý của chính mình. Bởi vậy, nhân dân có thể hoàn toàn đặt niềm tin dành cho các cơ quan này. Tuy nhiên, niềm tin của nhân dân trở nên mong manh khi các cơ quan chức năng chuyên trách lại không thống nhất, làm ảnh hưởng trức tiếp đến quyền và lợi ích hợp pháp của công dân.
Sự việc này xuất phát từ vụ việc vi phạm nhãn hiệu “xi măng Trung Sơn” của Công ty Xuân Mai và Công ty Cổ phần Tập đoàn Xây dựng và Du lịch Bình Minh. Được biết, nhãn hiệu xi măng Trung Sơn gắn liền với một dự án do Thủ tướng Chính Phủ đã phê duyệt có tên là “dự án xuyên thế kỷ” với mục đích phát triển ngành xi măng Việt Nam tại tỉnh Hòa Bình, dự án này đã được triển khai từ lâu và rất nổi tiếng. Tuy nhiên, bẽ bàng thay khi biết được “nhãn hiệu xi măng Trung Sơn” này đã bị một công ty khác đăng ký thương hiệu trước, đó là Công ty Xuân Mai. Công ty này đã được Cục sở hữu trí tuệ cấp Giấy chứng nhận đăng ký nhãn hiệu số 82099 “Trung Sơn – Xi măng pooclăng hỗn hợp – Hòa Bình – VN + hình”.
Trước tình hình trên, Công ty Bình Minh đã gửi công văn đề nghị hủy bỏ hiệu lực giấy chứng nhận đăng ký nhãn hiệu của Công ty Xuân Mai với lý do: “Phần chữ “Trung Sơn” trong sản phẩm của Cty TNHH Xuân Mai trùng với thành phần phân biệt “Trung Sơn” của tên “dự án nhà máy xi măng Trung Sơn” của Bình Minh. Trong khi đó, “dự án nhà máy xi măng Trung Sơn” đã được các cơ quan có thẩm quyền thừa nhận chính thức. Theo đó, “dự án nhà máy xi măng Trung Sơn” là chỉ dẫn thương mại dưới dạng tên thương mại của Cty Bình Minh, trong đó “Trung Sơn” là thành phần tạo khả năng phân biệt, đã được xác lập trước ngày cấp nhãn hiệu số 82099 cho Cty Xuân Mai. Vì vậy, Cty Xuân Mai sử dụng nhãn hiệu có phần chữ “Trung Sơn” trùng với thành phần phân biệt “Trung Sơn” trong chỉ dẫn thương mại “dự án nhà máy xi măng Trung Sơn” của Bình Minh đã được xác lập từ trước, là “hành vi cạnh tranh không lành mạnh”, gây thiệt hại cho quyền và lợi ích hợp pháp của Cty Bình Minh”.

Cục sở hữu trí tuệ đã tiếp nhận yêu cầu và ra quyết định 2470 hủy bỏ một phần hiệu lực giấy chứng nhận đăng ký nhãn hiệu số 82099 của công ty TNHH Xuân Mai. Công ty Xuân Mai không chấp nhận với quyết định trên và làm đơn khởi kiện Cục sở hữu trí tuệ. Tòa án nhân dân tỉnh Hòa Bình đã mở phiên toàn xét xử sơ thẩm chấp nhận yêu cầu khởi kiện của công ty Xuân Mai, đồng thời tuyên hủy quyết định số 2470 của Cục sở hữu trí tuệ về việc hủy bỏ một phần hiệu lực giấy chứng nhận đăng ký nhãn hiệu số 82099.
Rõ ràng, việc đăng ký nhãn hiệu của Công ty TNHH Xuân Mai là trái với các quy định của pháp luật, vi phạm quy định về cạnh tranh không lành mạnh. Bản thân dự án này ra đời trước khi Công ty Xuân Mai đăng ký nhãn hiệu hàng hóa. Việc Cục sở hữu trí tuệ quyết định hủy bỏ hiệu lực một phần giấy chứng nhận đăng ký nhãn hiệu “Trung Sơn – Xi măng pooclăng hỗn hợp – Hòa Bình – VN + hình” là có căn cứ pháp luật.
Để phán pháo lại quyết định của Tòa án nhân dân tỉnh Hòa Bình, Cục sở hữu trí tuệ đã kháng cáo lên Tòa phúc thẩm TAND tối cao. Sau khi nghe cấc bên trình bày, Tòa án nhân dân tối cao ra quyết định giữ nguyên quyết định số 2470/QĐ-SHTT và Quyết định 904/QĐ-SHTT của Cục SHTT. Vụ việc kéo dài và mất thời gian như vậy phải kể đến trách nhiệm của cơ quan nhà nước có thẩm quyền liên quan, đã không thống nhất và làm rõ được tính chất của vụ việc. Vụ việc trên cũng chính là một bài học để doanh nghiệp, cá nhân hoạt động kinh doanh thương mại cần đăng ký nhãn hiệu để bảo vệ quyền sở hữu công nghiệp của chính mình.
