Kiện “OTO NHÁI”của Trung Quốc – Vi phạm luật sở hữu trí tuệ.

       Tranh chấp nhãn hiệu, kiện “OTO NHÁI”của Trung Quốc – Vi phạm luật sở hữu trí tuệ. Vốn dĩ pháp luật ra đời là cán cân bảo vệ công lý và công bằng xã hội, là thước đó chuẩn mực cho mọi hành vi xử sự của con người. Tuy nhiên, cũng chính vì pháp luật ấy mà những quyền và lợi ích chính đáng của công dân không được bảo đảm. Câu chuyện về lỗ hổng pháp luật được nhắc tới trên đây liên quan đến pháp luật sở hữu trí tuệ Trung Quốc và vị việc Porsche kiện một công ty của Trung Quốc sản xuất ô tô nhái thiết kế.

       Trung tuần tháng 6 vừa qua, giới truyền thông Quốc tế đã rất bỡ ngỡ khi chào đón đứa con sinh đôi của hãng Porsche – là nhà sản xuất ô tô hạng sang của Đức. Thật  không mấy bất ngờ khi đứa còn đó lại sinh ra trên quê hương của chuyên gia làm nhái – Trung Quốc. Được biết đến là một cường quốc kinh tế lớn mạnh của Châu Á nói riêng và Thế Giới nói chung, rất nhiều sản phẩm của các quốc gia khác được đất nước này “làm lại” bản sao, trong đó oto Macan của hãng Porsche không nằm ngoài danh sách này.

        Phiên bản thật là mẫu SUV hạng sang cỡ nhỏ Porsche Macan. Phiên bản nhái được đặt tên là Zotye T700 với giá siêu rẻ của Zotye Auto tại Trung Quốc. Khi đặt hai sản phẩm này nằm cạnh nhau tuy không thể giống nhau hoàn toàn  nhưng dễ dàng nhận thấy những điểm tương đồng trắng trợn trong cách thiết kế như: “hốc gió lớn phía trước, đèn sương mù nằm thấp, viền cửa sổ hình quả hạnh, trần xe dốc về phía sau, tay nắm cửa, gương chiếu hậu đến đèn sau của Zotye T700, tất cả đều như được đúc từ một khuôn với Porsche Macan”.

       Trước tình hình trên, hãng Porsche đã quyết định đâm đơn kiện công ty Zotye Auto vì tội “làm nhái” thiết kế nói trên. Tuy nhiên, theo đánh giá của nhiều chuyên gia thì rất khó để kiện công ty Trung Quốc này bởi lý do đáng tiếc là luật sở hữu trí tuệ Trung Quốc quy định rất sơ sài và có nhiều lỗ hổng. Thật đáng buồn nếu nguyên nhân của việc “thua kiện” là bởi pháp luật.

        Kết quả vẫn đang chờ cơ quan chức năng Trung Quốc vào cuộc và xử lý. Hy vọng hàng thật sẽ được bảo vệ một cách thích đáng, chống lại được những hành vi cạnh tranh không lành mạnh nói trên.
